Update of Vietnams Work Permit Regulations for Foreigners in 2024
Every foreigner working and living in Vietnam is dealing with work permits. Typically, a work permit is necessary for employment exceeding three months and with a maximum stay of 2 years. Vietnam's recent work permit changes create a more balanced system and aims to attract workers from abroad, while including opportunities for domestic workers as well.
To work in Vietnam, foreign expatriates must meet the following criteria:
- Being at least 18 years old
- Specific qualifications that are relevant to the job
- Meeting health requirements
- Having a clean criminal record (in Vietnam and abroad)
- Valid work permit
- Temporary residence card
- Visa
Latest Changes for Work Permit in 2024
From January 1, 2024, businesses must announce Vietnamese worker recruitment on the Department of Employment or Employment Service Center portal, before applying for a foreign worker's work permit. Employers must advertise the position for at least 15 days on the government websites. This makes sure that Vietnamese citizens have a chance to get the job as well.
Furthermore, a direct degree match to the job description is no longer mandatory for "experts" or "technical workers." Relevant experience, as well as previously issued work permits in Vietnam can now function as proof of qualification and expertise.
The required supporting documents for business manager work permits are now clearly defined. These include the company charter, establishment certificate, and an official appointment resolution.
If all working locations are declared within the application (applicable within the same province/city), a single work permit is sufficient.
Workers wanting to renew their work permit with the same job position and title may not need to provide criminal records, expertise proofs, or technical labor documents again.
As well as foreign lawyers with practice licenses and foreigners married to Vietnamese citizens living in Vietnam are exempt from the work permit application processes.
The Ministry of Labor, Invalids and Social Affairs (MOLISA) or DOLISA issues work permits within a few days after receiving a complete application. DOLISA now handles work permit applications for foreign expatriates and if the application is rejected, a written explanation is getting send.
Certain individuals are exempted from the requirement of holding a work permit if they intend to work in the country for less than 3 months. These exemptions apply to specific categories, including members of limited liability companies (multiple members and sole owners). As well as members of the board of joint-stock companies.
Additionally, individuals visiting Vietnam for marketing purposes and lawyers granted professional permits are also exempted from the work permit requirement.
